  • Fictional locations and settings (including the Magic Garage and all derivative locations)

  • Character designs, visual elements, and distinctive features (including Leo's golden comet streak, Bolt's lightning bolts, and other character-specific magical elements)

  • Illustrations, artwork, graphics, and designs

  • Logos, trademarks, and brand names ("Zrrrum," "Magic Garage," and related marks)

  • Videos, animations, and multimedia content

  • Software, code, and site design

  • Educational materials and STEM resources

is the exclusive property of Zrrrum Studios LLC or its licensors and is protected by U.S. and international copyright, trademark, patent, trade secret, and other intellectual property laws.

Trademarks

"Zrrrum," the Zrrrum logo, "Max and Leo," "Magic Garage," and other marks displayed on the Site are trademarks or registered trademarks of Zrrrum Studios LLC. You may not use these marks without our prior written permission.

The Magic Garage, as a distinctive fictional setting and brand element, is a protected trademark and copyrighted work of Zrrrum Studios LLC.

Limited License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

  • Access and use the Site for personal, non-commercial purposes

  • View and download content solely for personal use

  • Purchase and enjoy our products in accordance with applicable product terms

Prohibited Uses

You may NOT:

  • Copy, reproduce, distribute, transmit, display, perform, publish, license, create derivative works from, transfer, or sell any content from the Site without our prior written permission

  • Use our characters (including Max, Leo, Bolt, and all derivative characters), stories, or artwork for commercial purposes

  • Use the Magic Garage concept, name, design, or any derivative fictional locations for commercial purposes

  • Use character-specific visual elements (including Leo's golden comet streak, Bolt's lightning bolts, or other distinctive magical elements) for commercial purposes

  • Create unauthorized merchandise featuring our intellectual property (including but not limited to toys, clothing, books, digital products, or adaptations)

  • Create or distribute competing children's books, stories, or content featuring substantially similar characters, settings, or concepts

  • Remove, alter, or obscure any copyright, trademark, or other proprietary notices

  • Use our content in any way that suggests endorsement or affiliation without permission

  • Reverse engineer, decompile, or disassemble any software or technology used on the Site

Fan Art and Non-Commercial Use

We appreciate the creativity of our community. You may create non-commercial fan art featuring our characters, provided that:

  • It is clearly identified as unofficial and not endorsed by Zrrrum

  • It does not imply any official affiliation or sponsorship

  • It is not sold or used for commercial purposes

  • It complies with community standards and does not depict inappropriate content

We reserve the right to request removal of any fan content that violates these Terms or our intellectual property rights.

4. Partner Content and Third-Party Rights

Licensed Content

Certain content on the Site may reference real-world racing circuits, drivers, teams, organizations, or other third parties (collectively, "Partners"). This content is used with permission or under license, or constitutes fair use for editorial and educational purposes.

You acknowledge that:

  • Partner names, likenesses, trademarks, and other intellectual property remain the property of their respective owners

  • You may not use Partner content independently from Zrrrum products

  • Partner relationships may change, and content may be updated or removed accordingly

Third-Party Links

The Site may contain links to third-party websites, including retail partners, racing organizations, and educational resources. We are not responsible for:

  • The content, accuracy, or practices of third-party sites

  • Products or services offered by third parties

  • Privacy practices of external sites

Your use of third-party sites is at your own risk and subject to their terms and policies.

5. User Accounts

Product Orders

Payment Processing

We do not store full credit card information on our servers.

Pre-Orders

For pre-order products:

  • You may cancel pre-orders in accordance with our cancellation policy

7. Returns, Refunds, and Cancellations

Return Policy

Physical Products (Books, Merchandise):

  • Returns accepted within 30 days of delivery

  • Products must be in new, unused condition with original packaging

  • Customer is responsible for return shipping costs unless the product is defective or we made an error

Digital Products:

  • Due to the nature of digital content, all sales are final

  • Refunds may be issued at our discretion in cases of technical issues or errors

Refund Processing

Approved refunds will be processed to the original payment method within 7-10 business days. Shipping costs are non-refundable unless we made an error.

Damaged or Defective Products

If you receive a damaged or defective product:

  • Contact us within 7 days of delivery at [support@zrrrum.com]

  • Provide photos and description of the issue

  • We will provide a replacement or full refund, including shipping costs

Cancellations

You may cancel an order before it ships by contacting us immediately. Once an order has shipped, our standard return policy applies.

8. User Conduct

You agree NOT to:

  • Violate any applicable laws or regulations

  • Infringe on intellectual property rights of Zrrrum or third parties

  • Upload or transmit viruses, malware, or other harmful code

  • Attempt to gain unauthorized access to the Site or our systems

  • Interfere with or disrupt the Site's operation or servers

Submission of Content

If you submit content to the Site (including reviews, comments, messages, or other materials), you grant Zrrrum a non-exclusive, royalty-free, perpetual, irrevocable, worldwide license to:

  • Use, reproduce, modify, adapt, publish, translate, and distribute your content

  • Create derivative works from your content

  • Display and perform your content

  • Use your content for promotional and commercial purposes

Content Standards

You represent and warrant that any content you submit:

  • Is your original creation or you have the right to submit it

  • Does not infringe on any third-party rights

  • Does not contain illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable material

  • Does not violate any law or regulation

  • Is appropriate for a family-friendly audience

Content Moderation

We reserve the right to:

  • Review, monitor, edit, or remove any user-generated content

  • Refuse to post or remove content that violates these Terms

  • Take action against users who post inappropriate content

We are not obligated to monitor user content but may do so at our discretion.

10. Educational Content and STEM Resources

Educational Purposes Only

Educational materials, STEM resources, and learning activities provided on the Site are for informational and educational purposes only. They are not intended as:

  • WARRANTIES REGARDING ACCURACY, RELIABILITY, OR AVAILABILITY OF THE SITE

  • WARRANTIES THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE

  • WARRANTIES REGARDING QUALITY OF PRODUCTS OR SERVICES

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ZRRRUM SHALL NOT BE LIABLE FOR ANY:

  • INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES

  • LOSS OF PROFITS, REVENUE, DATA, OR USE

  • BUSINESS INTERRUPTION

  • PERSONAL INJURY OR PROPERTY DAMAGE

ARISING FROM OR RELATED TO YOUR USE OF THE SITE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL ZRRRUM'S TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID TO ZRRRUM IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

Exceptions

Some jurisdictions do not allow limitations on warranties or liability. In such jurisdictions, the above limitations may not apply to you, and you may have additional rights.

13. Indemnification

You agree to indemnify, defend, and hold harmless Zrrrum Studios LLC, its officers, directors, employees, agents, licensors, and partners from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:

  • Your use of the Site

  • Your violation of these Terms

  • Your violation of any law or regulation

  • Your violation of any third-party rights, including intellectual property rights

  • Any content you submit or post

This indemnification obligation will survive termination of these Terms and your use of the Site.

14. Digital Millennium Copyright Act (DMCA)

Copyright Infringement Claims

If you believe that content on the Site infringes your copyright, please provide our designated Copyright Agent with the following information:

  1. Physical or electronic signature of the copyright owner or authorized representative

  2. Identification of the copyrighted work claimed to be infringed

  3. Identification of the infringing material and its location on the Site

Counter-Notification

Repeat Infringer Policy

We will terminate accounts of users who are repeat copyright infringers.

15. Dispute Resolution and Arbitration

Informal Resolution

Binding Arbitration

If informal resolution fails, any dispute arising out of or relating to these Terms or the Site shall be resolved through binding arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association (AAA).

Arbitration Terms:

Waiver of Jury Trial

YOU AND ZRRRUM WAIVE ANY RIGHT TO A JURY TRIAL.

Class Action Waiver

YOU AND ZRRRUM AGREE THAT DISPUTES MUST BE BROUGHT ON AN INDIVIDUAL BASIS AND NOT AS PART OF ANY CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. CLASS ARBITRATIONS, CLASS ACTIONS, PRIVATE ATTORNEY GENERAL ACTIONS, AND CONSOLIDATION WITH OTHER ARBITRATIONS ARE NOT PERMITTED.

16. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Commonwealth of Virginia, United States, without regard to its conflict of law principles.

For disputes not subject to arbitration, you agree to submit to the exclusive jurisdiction of the state and federal courts located in [Your County], Virginia.

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

21. Entire Agreement

These Terms, together with our Privacy Policy and any additional terms applicable to specific services or products, constitute the entire agreement between you and Zrrrum regarding the Site and supersede all prior agreements and understandings.

22. No Waiver

Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision. Any waiver must be in writing and signed by an authorized representative of Zrrrum.

23. Assignment

You may not assign or transfer these Terms or your rights and obligations without our prior written consent. We may assign these Terms without restriction. Any attempted assignment in violation of this provision is void.

24. Survival

Provisions of these Terms that by their nature should survive termination shall survive, including but not limited to: intellectual property rights, disclaimers, limitations of liability, indemnification, dispute resolution, and governing law provisions.
